MCQ in Philippine Bar Examinations: 2011 and Beyond

Law professors are suddenly moved by the decision of the Supreme Court (SC) to adapt the multiple choice questions (MCQ) for their midterm and final exams in their respective law subjects. As law students who were used to pyramid answers in essay-type questions are bewildered by this abrupt change. That's why many of the law professors and law disciples alike are preparing themselves for the new type of questions during examinations administered by their respective law schools/colleges in the country.

According to the SC, and I quote from the Philippine Daily Inquirer (PDI), "60 percent of the 2011 Bar examination will be multiple choice questions, while only 40 percent will be essay." But there's a twist in this type of exam when justices opined that examinees' answers in the essay part will only be checked unless they pass the MCQ part. (How sad and hard it is!)

The MCQ exams will have the following advantages (Ibid:PDI) "objective correction of the papers since every question has one definite answer; encouragement of the mastery of subject because of the difficulty of distinguishing between a correct and a nearly correct answer; and the employment of a wider scope of topics since the examiner can ask as many as 100 questions in an hour and a half exam, among others."

They say that the MCQ will test the examinees’ knowledge on codal provisions or provisions of the law “but also their comprehension and analysis.”

Because of this, I tried to make some simple reviewer of MCQ in my labor standard subject just to test my wit if I could answer basic MCQ in my preparation for my midterm and final exams, and hopefully during the BAR Exams in the future:

Sample MCQ in Labor Standards:

1. The government-owned and –controlled corporations “with original charter” refer to corporations chartered by special law distinguished from corporations organized under our general incorporation statute, the Corporation Code. Thus, under the present state of the law, GOCCs with original charter are subject to what law?

A. Labor Code
B. Corporation Code
C. Civil Service Law
D. Civil Service Rules

2. In the case of Euro-Linea Phils. Inc. vs. National Labor Relations Commission, it was held that in interpreting the Constitution’s protection to labor and social justice provisions and the labor laws and rules and regulations implementing the constitutional mandate, the Supreme Court adopts what approach which favors the exercise of labor rights?

A. Labor’s Welfare
B. Liberal’s Approach
C. Liberal Worker’s Approach
D. Laborer’s Approach

3. There are important principles for the entitlement to Maternity Leave under the SSS law. One of this is:

A. Full payment shall be advanced by the employer within 30 days from the filing of the maternity leave application

C. Maternity benefits shall be paid only for the first 2 deliveries of miscarriages

Thanks to this information and materials Mr. Cabalza. I had my first try of the MCQ during our recent mid-term exams, and I found it harder than the traditional essay-type questions. So technical that, even encircling the multiple choices, makes me so nervous. Most are tricky but there are some that are very familiar! Gosh, I almost cried after the exam...

here in davao city, we already began having mcq type of questions since june 2010 in our school. All i can say is, one must have a sharp memory and/or memory recall/retrieval during the exams. Taking health supplements for memory would be helpful.

Should it really be this taxing, my professor said it would only be basic questions of law.
Anyway thank you for your sample questions. I'm having a hard time getting samples from the Internet. Good job!

What makes the BAR exams distinct with other difficult board exams, is the essay type questions, where one is graded from his knowledge of the law and logical written arguments. Herein, although it's MQC just like other board exams are composed of, it will still be the toughest government and national examination in the country, and allegedly, in the world. My only worry is that, the prestige of taking the Bar exams will diminish because one would later feel like withdrawing bank notes over the atm, which is like taking an exam and the following days you'll immediately know the result. The mystery, surprises, and long agony of waiting would be over! Hence, another tradition will supersede past traditions! Hoping this will be for the better, however, I see it as very astringent and a tough exam!!!

We have used MCQs in our exams since last semester (2010), and have dismal results. Although the SC has released guidelines for law professors on how to construct these type of exams, we students, are at a lost on the quality of question stems.

I hope the professor, too, improved their way of constructing MCQ questions.

Some professor do not know how to ask questions and they even require their law students to compose the MCQ questions! What a shame to them! Asking students to make questions and selected good questions will later be asked during their own examinations! I wonder if these law professors are knowledgeable of the subjects they are teaching! Come on! Where's the delicadeza and originality of ideas! Isn't this an example of infringement? Copying the ideas of students to lessen the work of law professors? This is totally absurd!

The quality of questions we've been encountering in our exams is far from what I've been expecting. Law professors are not prepared to make MCQ. Yes SC has guidelines for law professors but I guess if these law professors who used to be undergrad professors or if they have background in education would be a great help in making MCQ.

I believe your number 1 MCQ sample question " Thus, under the present state of the law, the test in determining whether a government-owned or –controlled corporations is subject to what law? " is still vague.

Correct me if I'm wrong. Under our law, GOCC's with Original Charter is subject to the Civil Service Law, and those GOCC's created under the Corporation Code is under the Labor Code... So where is the question?

Even if you are asking the "test of determination" there is no answer in the choices.

Or it's just that I really don't understand your question? Correct if I am wrong or enlighten me on this...

MCQs may be an objective way of measuring a law student's working knowledge of the law and its applications. Provided however that the questions were properly formulated. Based on experience, some professor's do not know how to prepare good MCQs. Some questions are too lengthy.

I find your sample MCQ good and helpful material, in our school, some professors have difficulty constructing an MCQ and resort to their old way of writing an exam, definition, enumerate, discuss which is not helping us in anyway for the bar. Most law teachers had no experience in writing an MCQ, unless if they have an education background or teaching experience in the undergraduate. Many will be guided by the quality of the MCQ that will be ask in the November exam, the questions that where asked will be the genuine pig of the entire law students and law professors in the country in constructing an effective and efficient MCQ.

When I was still in law school, during my review class subject in remedial law. I did affirm and expected to my self That I almost perfect the MCQs portion of our med-term, but what made me mistake was, I flunked in the MCQs test. But I Got 99% from the essay questions which i could not imagine how it was happened because, it was beyond of my expextation and assessment.

when you do sample question on MCQ make sure to have your answer key. for obvious reasons , not all readers and the author share the same answer.

This is not supposedly to be a spoon feeding MCQs. That's why in law schools law students are not treated as college students to be fed with answers! I agree to the author that he did not put answers to these questions to let the readers think of the best answers! As law students, we should learn to unearth answers to MCQs by readings and studying well our law subjects in preparation to the BAR exams! Thanks to the author :-)

all the answers are almost correct what makes it differ is the hairline words that make it correct and others wrong... law students who are medical student from their undergraduate are of advantage since they know how to rationalize the correct answer from the wrong... that's their expertise and how they trained for to answer MCQs....so i won't be surprised if the topnotcher in the upcoming and future bar exams are medical students before.....hooorah!!!!!

After having taken the recent bar examations, all I can say is that the MCQ questions were designed to confuse and bewilder examinees, and not accurately guage the entry level skill and knowledge of those who wish to enter the legal profession.

It all boils down to what KIND of questions are asked.And the questions asked ranged from confusing to bewildering, to downright amusing ( ask anyone who has taken the recent bar about "Angel Kubeta").

From what I, as well as 6,000+ hopefuls have experienced, it was more of a "choose a winning lotto combination" rather than an exam.
